L.Varadaradjane v. Zenagame
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 07.06.2024
CORAM
THE HONOURABLE MRS. JUSTICE J. NISHA BANU & THE HONOURABLE MR.JUSTICE P.DHANABAL C.M.A.No.126 of 2018
1. Varadaradjane ...
Appellant Vs.
Zenagame ... Respondent Civil Miscellaneous Appeal filed under section 19 of Family Courts Act against the judgment and decree dated 15.06.2016 passed by the Family Court at Karaikkal in M.O.P.No.2 of 2015.
For Appellant : Mr. S. Giritharan For Respondent : Mr.T. Saikrishnan
JUDGMENT
This Civil Miscellaneous Appeal is preferred by the appellant/husband challenging the judgment and decree dated 15.06.2016 passed by the Family Court at Karaikkal in M.O.P.No.2 of 2015.
2. Today, when the matter is taken up for hearing, the learned counsel appearing for the appellant/wife submitted that he is not able to contact his client and reports no instructions from the appellant/wife. Learned counsel for the respondent/husband is present before the court.
3. Perusal of the records would go to show that the Civil Miscellaneous Appeal has been preferred by the appellant challenging the order passed in MOP.No.2 of 2015 declaring that the marriage solemnized on 11.09.1983 between the appellant/wife and respondent/husband as null and void.
4. Considering the fact that divorce was granted as early as on 15.06.2016 in MOP.No.2 of 2015 declaring the marriage as null and void and also the fact that the appellant counsel reports no instructions from his client, there will be no useful purpose served in keeping this matter pending on the file of this Court. In view of the above, this Civil Miscellaneous Appeal is dismissed. The order passed by the Family Court, Karaikal in MOP.No.2 of 2015 is hereby confirmed. No costs.
