..Respondent(s) PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondent Nos. 2 & 4 to consider Petitioners representation dated 09.01.2026 and direct the 2nd Respondent to conduct survey and demarcation of the land measuring an extent of 10 cents comprised in Patta No.64, New Survey No.331/7, situated at Navalur village, Pillaipakkam, Sriperumbudur Taluk, Kancheepuram District, and to specifically identify and demarcate the Petitioner's 5 cents share therein, the property being jointly held by two pattadhars, and consequently permit the
Petitioner to put up fencing along the demarcated boundaries of her 5 cents property, and further direct the 4th Respondent Police to provide adequate police protection at the time of survey, demarcation and fencing in the event of any obstruction from third parties, and pass such further or other orders. ORDER
This Writ Petition has been filed seeking for a direction to the second respondent to survey and demarcate the property, which according to the petitioner is owned by her, based on her online application dated 20.02.2026 within a time frame to be fixed by this Court.
2. The petitioner had submitted an online application on 20.02.2026 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this Writ Petition.
3. Mr.S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents 1 to 3. Mr.Meganathan, learned Government Advocate accepts notice on behalf of the fourth respondent.
4. This Court is not expressing any opinion on the merits of the petitioner's representation.
5. No prejudice will be caused to the second respondent if the said authority is directed to survey and demarcate the boundaries of the petitioner's property, more fully described in the prayer to this Writ Petition, after hearing the objections from the neighbouring land owners as well as any other third party, whom they deem it fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the second respondent is directed to issue notice to the neighbouring land owners as well as any other third party, whom they deem it fit to enquire.
(b) After receiving objections if any and after considering the same, the second respondent shall conduct survey and demarcate the boundaries of the property, more fully described in the prayer to this Writ Petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
(c) If the need arises for police assistance and on a request made by the second respondent, the fourth respondent shall render police assistance for the effective implementation of
this order.
