Though the earlier anticipatory bail petition of the petitioner was dismissed by my learned predecessor, Hon'ble Justice A.D.Jagadish Chandira, this petition is listed before this Court pursuant to the orders passed by the Hon'ble Division Bench of this Court in Crl.O.P.No.31787 of 2024 on 04.03.2025.

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 24(1) of COTPA Act r/w Section 77 of JJ Act in Crime No.299 of 2024, seeks anticipatory bail.

The case of the prosecution is that the petitioner was found in illegal possession of 102 packets of banned tobacco products. 5.

The earlier anticipatory bail application was dismissed by this Court in Crl.O.P.No.1939 of 2025, dated 28.01.2025, by making the following observations:

"5. Considering the gravity of offence committed by the petitioner, and that the bad antecedents of the petitioner and the fact that there has been no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner."

Considering the aforesaid facts, and since this Court, finds no change in circumstances, is not inclined to grant anticipatory bail to the petitioner.
