ORDER : The Court Made the following order :- The petitioner who was arrested at the hands of the respondent police for the alleged offences under Sections 8(c) r/w 20(b)(ii)(c) 25 and 29(1) NDPS Act, in Crime No.1402 of 2021 seeks bail.
2. The petitioner herein was arrested on 23.07.2021 while transporting 120 kg of contraband (Ganja) in Tata Indico Car bearing registration No.TN 67 AW 4950.
3. The learned counsel appearing for the petitioner submits that the owner of the car engaged the petitioner as an acting driver and further the petitioner never had conscious about the possession of the contraband (Ganja).
4. However, the learned Additional Public Prosecutor submits that the statement of the accused persons and other witnesses would reveal that the contraband (Ganja) was transported from Andhra Pradesh to https://hcservices.ecourts.gov.in/hcservices/
Tamil Nadu via Redhills and the same was intercepted by the respondent police and seized. She further submits that the investigation is almost completed and the final report has also been filed with material evidence incriminating the petitioner herein.
5. Considering the quantity of the contraband (Ganja) involved and the manner in which it has been transported, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. -sd/- 10/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
