Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the third and fourth respondents to recruit the petitioner who is registered with the Employment Exchange, Government of Pondicherry, in the year 1995, in any one of the vacancies arisen in the posts of Lower Divisional Clerk, Driver, Lab Attender, Farm Attender, Animal Attender and Peon in the third respondent's University before absorbing the staffs working under contingent payment with the third respondent University to the said vacancies.

O R D E R

Heard Mrs.Kavitha Deenadayalan, learned counsel for the petitioner; Mr.P.Visvas Soundaram, learned Government Advocate for the respondents 1 and 2 and perused the materials available on record.

2. The petitioner has come forward with this Writ Petition for issuance of Writ of Mandamus, directing the respondents 3 and 4 to recruit the petitioner, who is registered with the Employment Exchange, Government of Pondicherry, in the year 1995, in any one of the vacancies arisen in the posts of Lower Divisional Clerk, Driver, Lab Attender, Farm Attender, Animal Attender and Peon in the third respondent's University before absorbing the staffs working under contingent payment with the third respondent University to the said vacancies.

3. According to the petitioner, he has successfully completed 10th standard and registered with the Employment Exchange on 12.01.1995. Subsequently, he completed his driving and typing courses and again registered with the Employment Exchange on 21.09.2005 and 29.11.2006 with the said qualifications.

4. The grievance of the petitioner is that when a vacancy arose in the third respondent College, the Officials instead of appointing the persons through Employment Exchange, decided to absorb the temporary workers, who are already working in the College.

5. The learned counsel for the petitioner submitted that the representation of the petitioner dated 18.02.2011 was unattended by the respondents. Hence, the present Writ Petition and the petitioner would be satisfied if a direction is issued to consider the representation of the petitioner.

6. The learned Government Advocate for the respondents submitted that the representation of the petitioner would be considered in accordance with law.

7. In the case on hand, the Writ Petition has been filed based on the representation dated 18.02.2011, but no proof of service has been enclosed in the typed set. In the light of the facts of the case and the submissions of the counsel, the writ Petition is disposed of, permitting the petitioner to give a fresh representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. On such compliance, the

respondents shall consider the same and pass orders purely on merits and in accordance with law, after providing opportunity to all necessary parties, within a period of eight weeks therefrom.
