Respondents PRAYER: Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorarified Mandamus calling for the records relating to the order passed by the first respondent dated 28.01.2025 in letter No.01/NDHSS/Nagal/Sec/2025 quash the same and consequently direct the continuance of the petitioner in his office in the first respondent school as headmaster in-charge.

ORDER
The Writ Petition has been filed in the nature of a Certiorarified Mandamus seeking interference with an order passed by the first respondent dated 28.01.2025 and to permit the petitioner to continue to discharge his duties as Headmaster- in-charge of the first respondent School.
2. Let me not enter into a detailed discussion about the averments made in the affidavit, but only record that on 28.01.2025, the petitioner was visited by an order of suspension issued by the second respondent, who had been named in person. The petitioner has raised various grounds questioning such order of suspension.
3. At any rate, this Court had directed the order of suspension to be kept in abeyance. The petitioner has rejoined duty and is now function as Headmaster-in-charge of the first respondent school.
4. The learned counsel for the first and second respondents, very fairly stated that the petitioner may continue to discharge his duties, and to reserve the right of the respondents to proceed with the disciplinary proceedings. The first and second respondents are within their right to initiate disciplinary proceedings, however in manner known to law and in accordance with the procedure established by law.
5. The petitioner may, if visited by any charge memo or any show cause notice, take up all issues including issues of jurisdiction and every other objections. The petitioner also has a right to approach this Court if ever the petitioner is of the opinion that his right had been curtailed during
the course of enquiry proceedings.
6. The Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition stands closed. No order as to costs. 11.03.2025 vsg Index: Yes/No Internet: Yes/No Speaking / Non Speaking Order To 1.
