Writ of Mandamus has been instituted to direct the respondents 1 and 2 to forbear them from interfering with the petitioners respective houses at Sagaya Nagar, Bhudhur Essor (Port) Madhuranthakam Taluk, Kanchipuram District, in any manner, particularly, by way of removal or demolition of the same, pending disposal of the petitioners 2, 3 4 and 6 to 14, review petitions in SR.No.16738 to 16770 of 2026 on the file of this Court and the appeal pending with the Commissioner of Municipal Administration, the 3rd respondent herein dated 27.04.2016 by the 1st and 5th petitioners.

Admittedly, eviction proceedings had been initiated and the competent authority under the Land Encroachment Act, issued notice under Section 7 of the Act and after affording opportunity to the encroachers, issued final notice under Section 6 of the Act. The said final notice came to be challenged before the Appellate Authority namely, the District Collector, The District Collector adjudicated the issues by affording opportunity to the parties and rejected the appeal by order dated 17.07.2015. The appellate order of the District Collector remains unchallenged. However, the present writ petition is filed only seeking a direction to forbear the respondents from 3/6
interfering with their possession. In the absence of challenging the order passed by the District Collector under Section 10 of the Land Encroachment Act, the relief as sought for, cannot be granted.
3. The authorities identified the encroachments in Government land, classified as "Meikal proromboke"(grazing land). The appeal filed by the encroachers was dismissed by the District Collector. Under these circumstances, the learned counsel for the petitioners, Mr.L.Chandrakumar would submit that the case of the petitioners may be considered for providing alternative accommodation.

In this regard, the petitioners are at liberty to submit an application before the competent authority and the competent authority on receipt of such application may consider the same strictly in accordance with the terms and conditions of the Government scheme for providing alternate accommodation. If those encroachers are landless poor people, consider their cases for grant of accommodation by following the procedure. However, the competent authorities are empowered to remove the encroachments from the Government land.
5. In view of the above facts and circumstances, the respondents are 4/6
directed to evict the encroachers from the Government land and conclude the enforcement proceedings within a period of twelve weeks from the date of receipt of a copy of this order.
