The Writ Petition is filed under Article 226 of the Constitution of India to pass an order in the nature of Writ of Certiorari, to call for the records of the 1st respondent's Villupuram District Gazette notification No.4 dated 02.02.2011 in Na.Ka.No.B/G&M/1450/2010 dated 31.01.2011 in so far as it relates to S. No.6 of schedule -1.

O R D E R

The petitioner has filed the present Writ Petition to call for the records of the 1st respondent's Villupuram District Gazette notification No.4 dated 02.02.2011 in Na.Ka.No.B/G&M/1450/2010 dated 31.01.2011 in so far as it relates to S. No.6 of schedule -1.

2. According to the learned counsel for the petitioner, an appeal has been preferred by the petitioner against the order of the District Collector dated 25.01.2011 before the Appellate https://hcservices.ecourts.gov.in/hcservices/

Authority viz., the Commissioner, Geology and Mining, Guindy, Chennai. In the meantime, without awaiting the result of the appeal, the impugned notification was issued by the first respondent on 02.02.2011. Challenging the said impugned notification for tender cum auction in the subject matter in S. No.6, the present Writ Petition has been filed.

3. Further, the learned counsel for the petitioner would submit that the grant of further renewal insofar as the virgin quarry is concerned, they are not entitled for renewal of lease, beyond the lease period. The impugned notification has now become infructuous.

4. Therefore, in view of the efflux of time, nothing survives for adjudication in the Writ Petition. Accordingly, the Writ Petition is dismissed. No costs.
