ORDER

This Criminal Original Petition has been filed seeking to quash the private complaint pending in S.T.C.No. 230 of 2020 on the file of learned Fast Track Judicial Magistrate No.1, Erode.

2. Today, when the matter taken up for hearing, learned counsel for petitioner would submit that already the trial was commenced in a private complaint filed before the trial court. So, the prayer sought by the petitioner in this petition as such became infructuous.

3. In view of submission of learned counsel for petitioner stating that already the trial was commenced by the trial court in a private complaint filed in S.T.C.No. 230 of 2020, the prayer sought in this petition became infructuous. Accordingly, this Criminal Original Petition is dismissed as infructuous. However, liberty is granted to the petitioner to work out his remedy and raise all its defence before the trial court.
