The application in A.No.1432 of 2023 has been filed by the applicants, who are the first and second defendants, seeking to condone the delay of four (4) days in filing the Additional Written Statement in C.S.(Comm.Div.)No.134 of 2022.

2. This Court, by order dated 04.01.2023, permitted the applicants to file their Additional Written Statement within four weeks. However, the Additional Written Statement was filed only on 06.02.2023 with the delay of four (4) days.

3. The only objection made by the learned counsel for the respondents is that the provision of law quoted by the applicant is not correct.

4. It is settled law that quoting a provision of law cannot be a ground to refuse the relief and therefore, this Court treats this application as the one filed under Order VIII Rule 9 of CPC. https://www.mhc.tn.gov.in/judis 1/2
