ORDER
The prayer in the writ petition is to direct the first respondent to consider the petitioner's representation dated 28.01.2025 to provide an electricity connection to the petitioner's house property situated at S.No. 316/20, Mangalam Village, Palliyagaram Post, Madurantakam Taluk, Chengalpattu District.
2. When the matter came up for hearing, the learned counsel appearing on behalf of the respondents submitted that it is true that the petitioner made an application. However, the property is a joint family property and the petitioner did not enclose the necessary forms from the other co-owners. Therefore, the application could not be considered and now it has lapsed.
3. In that view of the matter, if the property is a joint family property, the petitioner shall obtain the consent of the other co-owners. If the petitioner is unable to obtain consent from every co-owner, the petitioner can furnish an indemnity bond and apply for the connection, which will be considered by the 2/4
respondents in accordance with the terms of the supply of energy. However, the petitioner has to make a fresh application.
4. In view thereof, this writ petition is disposed of with the following terms:- (i) Along with a copy of this order, the petitioner shall make a fresh application for grant of electricity connection for the above mentioned premises;
(ii) The petitioner shall also obtain consent from the other co-owners;
(iii) If the petitioner is unable to produce consent from the other co-owners, the petitioner shall furnish an indemnity bond. Upon submission of the indemnity bond, the respondents shall consider the petitioner's application in accordance with the law;
(iv) The petitioner shall submit the application within one week from the date of receipt of the web copy of this order. Upon submission, the authority shall process the application and pass final orders within twelve weeks; and (v) The parties shall act on the web copy of the order without waiting for the certified copy.
