ORDER
This writ petition has been filed challenging the impugned notice dated 24.12.2024 issued by the 5th respondent and for a consequential direction to respondents 5 and 8 not to measure or issue any fresh patta and not to make any further sub-division and register documents pertaining to the subject property situated in Survey Nos.126 to 184 at Saravambakkam Villlage, Peruvelli Revenue Village, Mathuranthagam Taluk, Chengalpattu District.
2.Heard Mr.S.Arokia Mani Raj, learned counsel for the petitioner, Mr.M.R.Gokul Krishnan, learned Additional Government Pleader for R1 to R9, Mr.T.P.Manoharan, learned Senior Counsel for R11 to R14 and Mr.B.Sasindran, learned counsel for R10. 3 / 6
3.In the considered view of this Court, a substantive writ petition has been filed before this Court by way of a public interest litigation in W.P.No.31794 of 2023, wherein the petitioner has sought for a direction to conduct an enquiry in respect of the lands in Survey Nos.126 to 184 and to confiscate these lands in the said survey numbers and to distribute the same to the real beneficiaries of the same village. Admittedly, this writ petition is pending. In the meantime, one writ petition after the other is being filed before this Court whenever any notice is issued and whenever steps are being taken to survey the property. If at all the petitioner is aggrieved by any such notice issued, he can only seek for an interim order in the pending public interest litigation in WP.No.31794 of 2023.
Ultimately, the substantive relief is pending before this Court and in view of the same, if there are any further developments, petitions must be filed in the pending writ petition and the petitioner cannot be allowed to file one writ petition after the other touching upon the same issue. 4.In view of the above, this Court is not inclined to interfere with the impugned proceedings of the 5th respondent dated 24.12.2024. This is only a notice issued calling for objections and if there are any objections, the petitioner can appear before the 5th respondent and give his objections along with the relevant documents.
petitioner has to move an appropriate petition in the pending public interest litigation petition. Except giving this clarity, no further orders can be passed in this writ petition. 5.In the result, this writ petition is disposed of in the above terms. No costs.
