(CRIME NO.664 OF 2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extent the time to comply the condition imposed in Para No.5(b)" Rs.20,000/- (Rupees Twenty Thousand Only (Rs.10,000/- each)) to the Registered Advocate Clerks Association, Namakkal and on such deposit, the petitioner shall execute two sureties for a sum of Rs. 10,000/- (Rupees Ten Thousand Only), before the learned Judicial magistrate, Sendamangalam, Salem within 15 days from the date of Commencement of the Court`s normal functioning, failing which the bail granted by this Court shall stand dismissed automatically" of the order dated 10.01.2022 in Crl.O.P.No.2123 of 2022 in Crime No.664 of 2022 pending investigation on the file of the respondent Police.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. R.THIRUMOORTHY, Advocate for the petitioner, and of MR.S.SANTHOSH, Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed by the petitioners to extend the time to comply with the condition made in Crl.O.P.No. 2123 of 2022 dated 01.02.2022.
2. This Court on 01.02.2022, while granting bail to the petitioners imposed a condition that the petitioners should deposit a sum of Rs. 10,000/- each to the Registered Advocate Clerk's Welfare Association, Namakkal. within a period of fifteen days.
3. The learned Government Advocate (Crl. Side) submits that the above stated condition was not complied by the petitioners.
4. The learned Counsel appearing for the petitioners states that the petitioners could not able to raise funds to deposit a sum of Rs.10,000/- each and hence, they could not able to comply with the condition.
5. Taking note of the submissions made by the learned counsel for the petitioners, for depositing a sum of Rs.10,000/- each, time is extended till 15.03.2022 with a condition that no further extension of time will be granted failing which, the bail granted will be automatically cancelled without any reference to this Court. -sd/- 04/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
