PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the 1st respondent to complete the investigation on the petitioner's complaint dated 25.3.2023 which was transferred from the Inspector of Police, Rajadhani Police Station, Andipatti Circle, Theni District to 1st respondent upon jurisdiction, by the order of this Court made in Crl.Op.(MD) NO.9361/2023 dated 27.6.2023.

ORDER

This criminal original petition has been filed to direct the 1st respondent to complete the investigation on the petitioner's complaint dated 25.3.2023 which was transferred from the Inspector of Police, Rajadhani Police Station, Andipatti Circle, Theni District to 1st respondent upon jurisdiction, by the order of this Court made in Crl.O.P.(MD) No.9361/2023 dated 27.6.2023.

2.When the matter came up for hearing on 04.02.2024, this Court passed the following order:

The learned Additional Public Prosecutor takes notice on behalf of the respondents and seeks for some time. 2.It is brought to the notice of this Court that the allegation pertains to job racketing. Therefore, if the complaint makes out the cognizable offence, the FIR has to be registered and the investigation must be taken up in accordance with law. It is seen from records that the petitioner had already filed a petition in Crl.M.P.(MD)No.9361 of 2023 before the Madurai Bench of the Madras High Court and this petition was disposed of by an order dated 27.06.2023 in the following terms:

2.When the matter is taken up for hearing today, the learned Additional Public Prosecutor would submit that 2/4

upon the jurisdiction, the above said investigation is transferred to Salem District Crime Branch, the petitioner is also present before the concerned authority that he would work out remedy before the District Crime Branch, Salem. So, the matter has become infructous.

3.The learned Additional Public Prosecutor shall take instructions from the 2nd respondent and report before this Court. 4.Post this case under the same caption on 18.03.2024. 3.When the matter was taken up for hearing today, the learned Additional Public Prosecutor submitted that the FIR was registered in Crime No.8 of 2024 on 15.03.2024 for offence under Sections 420, 465, 468 and 471 of IPC. 4.In view of the above, this criminal original petition is disposed of with a direction to complete the investigation in Crime No. 8 of 2024, within a period of six months from the date of receipt of copy of this order. 18.03.2024 Index: Yes/No Speaking order/Non-speaking Order ssr 3/4
