E.ANBARASAN Advocate For Respondent : MR. V.BALAMURUGANE, Public Prosecutor for Puducherry PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for an offence under Sections 379 IPC and 3(1) of the Prevention of Damage to Public Property Act, 1984 in Crime No.339 of 2021, seeks anticipatory bail.

2. It is the case of the prosecution that the petitioner was involved in illegal transportation of river sand.

3. It is seen from records that this is the fourth bail petition filed by the petitioner. The previous order, dismissing the Criminal Original petitions in Crl.O.P.Nos.19355, 23101 & 25821/2021 were passed by this Court on 25.10.2021, 03.12.2021 & 05.01.2022, respectively.

4. The learned Government Advocate (Crl. side) submitted that there is no change in circumstances after the previous order was passed on merits. Hence, the learned Government Advocate vehemently opposed to grant bail to the petitioner.

In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the fourth bail petition. Hence, this Criminal Original petition is dismissed.
