ORDER

This petition has been filed for direction to direct the second respondent to execute the warrant against the first respondent issued on 25.10.2019 in M.C.No.3 of 2014 on the file of the learned Judicial Magistrate at Arakkonam.

The petitioner is the wife and the first respondent is her husband. They got married and thereafter due to misunderstanding they got separated. The petitioner is living separately and as such she could not able to maintain herself. Therefore, she filed maintenance case in M.C.No.3 of 2014 on the file of the learned Judicial Magistrate, Arakkonam. It was allowed and the first respondent was directed to pay monthly maintenance of Rs.3,000/- to the petitioner. Thereafter, the first respondent failed to comply the same and as such the petitioner filed petition in C.M.P.No.2683 of 2018 in M.C.No.3 of 2014 for issuance of warrant as against the petitioner. Accordingly on 25.10.2019, a warrant was issued as against the petitioner and the same is pending before the first respondent without executing the same.

Considering the above facts and circumstances, the second respondent is directed to execute the warrant issued as against the first respondent dated 25.10.2014, within a period of two weeks from the date of receipt of a copy of this Order.

With the above directions, the Criminal Original Petition stands disposed of.
