PRAYER: Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus directing the third respondent to consider the petitioner's representation dated 24.12.2024. For Petitioner :

The petitioner has filed this petition seeking to direct the third respondent to consider the petitioner's representation dated 24.12.2024.

2. Since no adverse order is being passed, this writ petition is taken up for final hearing.

3. The case of the petitioner is that she is the absolute owner of the agricultural property situated at Namakkal District, Vadakaraiyathur, Melmugam Village Comprised in Survey.No.512/2 measuring an extent of 1 Acre 53 1⁄4 cents and 0.50 cents within the Registration District of Namakkal and Sub registration District of Paramathi. She purchased the above said Page No.2 of 7

property from her Vendor Mr.M.Ponnusamy and others by registered Sale Deed Vide in Document No.652/2001 dated 06.06.2001 and then, she is in possession and enjoyment of the above said property without any encumbrance and she is cultivating crops in the above lands till now. Her husband passed away before 40 years. Earlier, she had settled the above said 1 Acre 50 cents of agricultural land in favour of her daughter Mrs.Deva by way of registered Settlement Deed vide in Document No.5926/2024 dated 05.12.2024. The grievance of the petitioner is that her son had created a forged and fabricated document for the 53 1⁄2 cents and obtained loan from finance company. And on 01.12.2024, her son dispossessed the petitioner from her above house. Pursuant to which, the petitioner has submitted her representation to the respondents on 24.12.2024 by registered post. So far the respondents did not consider her request and had not take any steps under senior citizen Act. Aggrieved by the same, the petitioner has come forward with the present writ petition.

4. Though very many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice if this Court issues direction to the fourth respondent to consider the petitioner's Page No.3 of 7

representation dated 24.12.2024 and pass appropriate orders on merits and in accordance with law, within a time frame to be fixed by this Court.

5. Learned Government Advocate appearing for the respondents 1, 3 & 4 has no objection for the said order being passed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Considering the limited prayer sought for by the learned counsel for the petitioner, this Court without going into the merits of the case issues direction to the fourth respondent to consider the petitioner's representation dated 24.12.2024 after issuing due notice to the petitioner as well as the sixth respondent, affording an opportunity of personal hearing and conducting enquiry on merits, in accordance with law and pass appropriate orders, within a period of three months from the date of receipt of a copy of this order.

8. This writ petition is disposed of with the aforesaid observation and direction. No costs.
