ORDER

This writ petition is filed for a direction directing the respondents to implement the order passed by this Court in W.P.No. 395 of 2014, thereby directed to consider the representations submitted by the petitioner. 2.The petitioner, while working as Village Administrative Officer, on the complaint lodged by one Durai, FIR has been registered by the District Vigilance and Anti Corruption department, Villupuram, alleging receipt of bribe against the petitioner. It was registered in Crime No.05/AC/2013/VPM for the offences under Section 7 of the Prevention of Corruption Act. The case was taken on file in Spl.C.C.No.66 of 2014, on the file of the Sessions Court, Villupuram. After due trial, the petitioner was convicted and sentenced to undergo imprisonment.

Aggrieved by the same, the petitioner had preferred an appeal before this Court and the sentence alone was suspended by this Court. From 08.07.2013, the petitioner was suspended from service. Pending Trial, the suspension order of the petitioner has not been reviewed. As it was not considered, the petitioner filed W.P.No.395 of 2014 and this Court, by an order dated 11.08.

3/4 petitioner. Since the said order has not been complied, the petitioner has filed the present writ petition.

3.Since the petitioner was convicted by the Criminal Court for the offences under Section 7 of the Prevention of Corruption Act, the representation submitted by the petitioner for revocation of suspension from service cannot be considered. Once Criminal Court has convicted the petitioner, he cannot be reinstated into service. Therefore, the direction sought in this writ petition cannot be considered. The writ petition is devoid of merits and is liable to be dismissed.

4.Accordingly, this writ petition stands dismissed. There shall be no order as to costs.
