ORDER
This application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996 (in short "the Act") seeking for an order of interim injunction restraining the 1st respondent from interfering with the peaceful functioning of the 5th Respondent partnership firm M/s.Sri Valli Vilas MV Pavadai Sons and the discharge of the functions of its Managing Partner Mr.S.Srinivasan and his son Mr.S.S.Vigneshram, pending disposal of the arbitration proceedings.
2.The 1st respondent is represented through counsel and the learned counsel for the 1st respondent submitted that the 1st respondent is not causing any hindrance in the matter getting settled amicably between the parties and that the 1st respondent will not interfere with the peaceful functioning of the 5th respondent partnership firm.
3.It is also brought to the notice of this Court that the matter has been posted before the Arbitral Tribunal tomorrow and that, in all probability, the matter will be amicably settled between the parties. 2/4
4.In the light of the above development, this Court is inclined to record the submission made by the learned counsel for the 1st respondent and dispose of this application and accordingly, this application is disposed of. It is made clear that the 1st respondent will not put spokes in the smooth functioning of the 5th respondent partnership firm and this order will not stand in the way of the 1st respondent productively participating in the affairs of the business. 09-02-2026 gya Index:Yes/No 3/4
