..Respondent Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the Refusal Check Slip in Refusal No.RFL/Harur/142/2025 dated 21.08.2025 and to quash the same as illegal incompetent and ultra vires and consequently direct the Respondent to register the Settlement deed dated 07.08.2025.

ORDER

Asserting title under sale deed dated 17.09.2003 bearing document no.2136/2003, the petitioner presented settlement deed dated 07.08.2025 for registration. Such request was declined under impugned refusal check slip dated 21.08.2025.

2. Learned counsel for the petitioner submits that patta nos.348 & 591 stand in the name of the petitioner in respect of the relevant property. Therefore, she submits that the refusal to register is untenable and that interference is warranted.

3. Mr.Stalin Abhimanyu, learned Additional Government Pleader, accepts notice for the sole respondent. He points out that the request for registration was refused in view of conflicting claims being made under registered documents such as exchange deed bearing document no.329/2000. In any event, he submits that the registering officer would reconsider the matter after issuing notice to parties concerned.

4. The documents on record include sale deed dated 17.09.2003 bearing document no.2136/2003 and patta numbers 348 & 591 in the name of the

petitioner. In these circumstances, reconsideration is warranted. In order to facilitate the same, the impugned refusal check slip is set aside.

5. As a corollary, the petitioner is permitted to re-present the settlement deed for registration within two weeks from the date of receipt of a copy of this order. Within 30 days therefrom, the registering officer shall either register the settlement deed or issue a speaking order of refusal under Section 71 of the Registration Act, 1908. Before taking either of these decisions, notices shall be issued to all parties interested and relevant.
