The petitioner who was arrested and remanded to judicial custody on 06.09.2023 for the offences registered by the respondent Police under Sections 302, 201, 212, 342, 114, 34 and 109 of IPC, in Crime No.954 of 2023, seeks bail.

2. A1 is the son of the present petitioner. It is stated that there are 17 previous cases as against the petitioner including 2 cases under 302 IPC. 3.The learned counsel for the petitioner stated that those cases had ended in acquittal.

4.The case of the prosecution is that A1 to A3 were waiting in the backside of the house of the defacto complainant and when that was questioned, they came later in the evening and had murdered the husband, mother-in-law, brother-in-law and a neighbour. 5.The defacto complainant and her minor son are the eye-witnesses and they are vulnerable witnesses.

6.It is also seen that the learned Sessions Judge had also fixed the date for trial. Both the Court and the witnesses and also the accused must be given opportunity to proceed with the case on the scheduled dates. 7.At this stage, I am not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed.
