ORDER

This Criminal Original Petition has been filed seeking modification of the condition imposed by the learned Principal Sessions Court, Puducherry, in Crl M.P. No.130 of 2026 dated 27.01.2026.

2.The petitioner is alleged to have committed an online scam by inducing two victims to part with a sum of Rs.14.5 lakhs. He was arrested and remanded to judicial custody on 27.12.2025. Thereafter, the petitioner approached the learned Principal Sessions Court, Puducherry, seeking bail. Upon considering the case on merits, the learned Sessions Judge was inclined to grant bail, subject to certain conditions, including the production of property documents worth Rs.15 lakhs as security or furnishing one surety. 3.The petitioner seeks modification of the said condition on the ground that it is onerous. He submits that he has not made any statement agreeing to deposit any documents for the purpose of bail. The learned counsel for the petitioner further contends that the condition imposed is excessive and that the petitioner is ready and willing to co-operate with the trial proceedings. He therefore prays that this Court may modify the said condition and grant appropriate relief.

4.This Court has perused the earlier orders passed by the learned Sessions Court and the connected materials on record. It is revealed that the petitioner is allegedly involved in cheating two victims to the extent of Rs.14.5 lakhs. The condition directing the petitioner to produce property documents as security has been imposed by the Sessions Court in view of the nature and gravity of the allegations. However, imposing a condition requiring deposit of property documents without any offer or undertaking from the petitioner appears to be onerous, particularly when such a condition may effectively deprive him of the benefit of bail if he is unable to comply due to financial constraints. 5.In view of the above, this Court is of the opinion that the learned Sessions Judge shall reconsider the bail condition in the light of the observations made herein. Accordingly, the matter is remitted to the trial Court for passing appropriate orders in accordance with law. 6.Consequently, this Criminal Original Petition is disposed of. 12-02-2026 GBI
