ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.07.2025 for the alleged offence punishable under Section 366 of IPC, and under Sections 5(1) r/w 6 of Protection of Child from Sexual Offences Act, 1/4

2012, in S.C.No.76 of 2021 is pending on the file of the learned Court of Sessions, Magalir Needhi Mandram (Fast Track Mahila Court), Tiruppur in connection with Crime No.01 of 2021, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was earlier arrested and released on bail. Subsequently, due to health issue, the petitioner failed to appear before the concerned trial Court, and hence Non-Bailable Warrant (NBW) was issued against him on 16.09.2022, and the same was executed on 01.07.2025.

3. Learned counsel appearing for the petitioner submitted that due to health issue, the petitioner was unable to appear before the concerned Trial Court. He further submitted that the petitioner is in judicial custody since 01.07.2025. Hence he prays to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has failed to appear before the concerned Court on 16.09.2022, pursuant to which a NBW was issued against him. He further submitted that the petitioner had absconded for nearly three years in order to stall the trial proceedings. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the fact that the petitioner had absconded for more than 2/4

three years and that the trial is now in progress, this Court is not inclined to grant bail to the petitioner.
