Court notice was served to the fourth respondent and private notice served to the third respondent. Though the names of the respondents 3 and 4 appear in the cause list, there is no representation on behalf of them. Heard the learned counsel for the petitioner and the 2nd respondent Being satisfied with the reasons assigned in the affidavit filed along with the petition, the delay of 39 days in filing the appeal is condoned.

Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order. Registry is directed to print the name of Ms.I.Malar, counsel for the 2nd respondent, at the time of admission.
