S.SANTHOSH, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehends arrest for the alleged offences under Sections 341, 294(b), 427, 323, 324, 506(ii) of IPC in Crime No.372 of 2021, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioners herein had restrained and damaged the car of the defacto complainant and also brutally attacked the defacto complainant and his friend Arun. In which the defacto complainant had sustained leg injury and admitted in the hospital on 12.09.2021 and further discharged on 14.09.2021.
3. The learned counsel for the petitioner submits that already the petitioners have filed a complaint against the defacto complainant along with 11 others for an alleged offence of assaulting and abusing them in the name of their community on 12.09.2021. He further submits that they were admitted to the Government Dharmapuri Medical College Hospital, Dharmapuri for treatment and they were treated as in patient and https://hcservices.ecourts.gov.in/hcservices/
discharged on 14.09.2021. The learned counsel for the petitioner has produced a copy of the FIR based on the complaint given by the petitioners against the defacto complainant and others.
4. This court finds that it is a belated complaint with intention to get rid of the crime committed by the petitioners herein in the Crime No.372 of 2021. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
