A4 and A5 have filed Crl.O.P.No.3957 of 2024 and A6 has filed Crl.O.P.No.4027 of 2024 both seeking bail in Crime No.466 of 2023 originally registered by the respondent Police for the offences under Sections 302 and 201 IPC and later, altered to sections 120B, 147, 148, 302, 201 of IPC r/w 149 IPC. The petitioners in Crl.O.P.No.3957 of 2024 had been remanded to judicial custody on 06.11.2023 and the petitioner in Crl.O.P.No.4027 of 2024 had been remanded to judicial custody on 08.11.2023.

2.The occurrence had taken place on 19.09.2023. It is stated that the defacto complainant, Village Administrative Officer of North Vellore had received information about a body in a blanket and tied to a stone and thrown in the water in the Moat near Vellore Fort. The body was recovered. It was found that the deceased was a Police informer and all the accused had committed the murder of the deceased and had thrown the body into the moat near Vellore Fort.

3.The investigation has been completed and the matter is now pending before the learned Judicial Magistrate No.IV, Vellore as P.R.C.No.13 of 2024.

4.A counter affidavit had been filed on behalf of the respondent, wherein, it had been stated that A5 has 3 previous cases, A6 has 1 previous case and A4 has 9 previous cases. The list of cases have also been given. The other accused are also in jail. A1 has 7 previous cases and A2 has 2 previous case and A3 has 1 previous case. Among the accused, one of the accused is also a juvenile.

5.It is thus seen that all the accused have previous cases and therefore, a very strong motive to commit the murder of the deceased, who was a police informer and they had also thrown the body in the moat, near Vellore Fort, tied with a stone.

6.Taking all these factors into consideration, this Court is not inclined to grant bail to the petitioners.

7.Hence, these Criminal Original Petitions are dismissed. 04.03.2024 vkr 2/3
