PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the 3rd respondent relating to Govt.Lr.No.26274/b2/2009-9 Public Works Department dated 22.11.2010, quash the same and issue consequential directions to the respondents to redesignate the petitioner 1/4

as Assistant Engineer from 17.01.1999, the date of acquiring the B.E.Degree, fix seniority in that cadre and consider him for inclusion of name in the panel of Assistant Engineers fit for promotion as Assistant Executive Engineers for 2008-2009, 2009-2010 and to promote him as such with retrospective effect from the date of promotion of his immediate junior with consequential benefits. ORDER

The Writ Petition is filed calling for the records of the 3rd respondent relating to Govt.Lr.No.26274/b2/2009-9 Public Works Department dated 22.11.2010, quash the same and issue consequential directions to the respondents to redesignate the petitioner as Assistant Engineer from 17.01.1999, the date of acquiring the B.E.Degree, fix seniority in that cadre and consider him for inclusion of name in the panel of Assistant Engineers fit for promotion as Assistant Executive Engineers for 2008-2009, 2009-2010 and to promote him as such with retrospective effect from the date of promotion of his immediate junior with consequential benefits.

2. When the matter is taken up, the learned counsel for the petitioner seeks permission of this Court to withdraw the petition. He has also made an endorsement to that effect in the court record.

3. In view of the above submission, this Writ Petition is dismissed as withdrawn. No costs.
