[Made by S.M.SUBRAMANIAM, J.,] This writ petition has been filed seeking a direction to Respondents 1 and 2 to dispose of the representation of the petitioner dated 22.12.2025 seeking to evict the 4th respondent from Plot No.D.P.No.84A (NP), SIDCO Page Nos.2/6

Industrial Estate, Ambattur, Chennai and thereafter hand over vacant and peaceful possession of the said plot to the petitioner and also to direct the third respondent to extend adequate police protection to the first and second respondents for the purpose of effective eviction and removal of the 4th respondents who are the unauthorized encroachers and for ensuring delivery of vacant possession of the said plot to the petitioner.

2. It is the case of the petitioner that an industrial plot has been allotted by the Tamil Nadu Small Industries Development Corporation Limited ['TANSIDCO' in short], however, allotted plot was not handed over to the petitioner enabling him to use it for industrial purposes.

The learned counsel for the petitioner would submit that earlier a writ petition was filed by the writ petitioner in W.P.No.3881 of 2007 and this Court passed an order on 02.09.2009 directing the respondents in the said writ petition to issue final allotment order and execute necessary documents in favour of the petitioner, after collecting the amount, if any, due including interest etc., from the petitioner. However, the said direction would not provide a cause for filing the present writ petition seeking removal of encroachment.

4. The learned Mr.T.Arun Kumar, learned Additional Government Pleader would submit that the industrial plot allegedly allotted in favour of the petitioner is kept for public purposes.

5. Admittedly, the TANSIDCO has not handed over possession of the industrial plot to the petitioner and therefore, the petitioner has to approach the TANSIDCO for removal encroachment, if any, made in the plot allotted in his favour. It is for the TANSIDCO to initiate all appropriate actions in accordance with law.

With these observations, the writ petition stands disposed of. No costs.
