This Petition has been filed to set aside and restore the Second appeal No.623 of 2006, which was dismissed for non-prosecution on 02.09.2014.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsels on either side, the petition stands allowed.

4. Registry is directed to restore the above Second Appeal No.623 of 2006 and Post the case on 11.03.2025.
