C.M.P.No. 11892 of 2020 in C.M.A.SR.No.22043 of 2020 SUNDER MOHAN, J This Petition has been filed seeking to condone the delay of 1703 days in filing the above Civil Miscellaneous Appeal.

2. R1, the father of the deceased is no more. The respondents 2 to 5 are his legal heirs. Though a learned counsel had entered appearance for R2 to R5, there is no representation today.

Learned counsel appearing for the petitioner/appellant would submit that R6 and R8 remained ex-parte before the Tribunal and notice may be dispensed with to the R6 and R8. Hence, notice dispensed with. Though R7 has been served none has entered appearance.

2. Heard the learned counsel for the petitioner.

3. Considering the reasons stated in the affidavit filed in support of this petition, this Court is of the view that the delay can be condoned on condition that the petitioner shall pay a cost of Rs.2,000/- to the Tamil Nadu State Legal Services Authority, High Court Campus, Chennai within a period of two weeks.
