ORDER

This Criminal Original Petition has been filed to set aside the order dated 06.12.2021 passed in Crl.M.P.No.8423 of 2021 in S.C.No.127 of 2021 pending on the file of the Principal District Judge, Villupuram, 1/4

thereby dismissing the petition filed under Section 311 of Cr.P.C to recall the prosecution witnesses.

2. The learned Additional Public Prosecutor would submit that after challenging the same before this Court, he was absconding and NBW was issued against him. He is a sole accused and also the prosecution has registered an FIR as against him and the NBW is pending against him.

3. In view of the above, this Court is not inclined to set aside the order passed by the Court below. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
