Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 1st respondent herein to consider and pass appropriate orders on the petitioner's representation dated 03.06.2019 seeking alteration of his Date of Birth in the Service register based on his application dated 27.10.2010. This writ petition has been filed for issuance of a writ of mandamus directing the 1st respondent to consider the representation made by the petitioner who is seeking for alteration of his Date of birth in the Service Register. 2.The case of the petitioner is that actually the petitioner's Date of birth is 11.11.1963 and it has been
wrongly entered as 01.07.1962. The petitioner was appointed as Junior Assistant on 25.02.2010. Immediately after finding that his Date of birth has been wrongly mentioned, he submitted an application on 27.12.2010 seeking for alteration of the Date of birth. Since no action was taken on the application submitted by the petitioner, the petitioner filed W.P.No.33448 of 2019 before this Court. This writ petition was dismissed by an order dated 29.11.2019 on the ground that the petitioner did not file any proof for having submitted an application on 27.12.2010.
3.Subsequent to the dismissal of the writ petition, the petitioner applied under Right to Information Act seeking for copy of his application that was given by him on 27.12.2010. The availability of the application was admitted by the respondents and a copy was also furnished to the petitioner. Therefore, armed with the said document, the present writ petition has been filed before this Court seeking for appropriate directions.
4.Heard the learned counsel for the petitioner and the learned counsel appearing on behalf of the respondents. 5.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 1st respondent to consider the application made by the petitioner on 27.12.2010 seeking for alteration of Date of birth and deal with the same strictly in accordance with law and pass appropriate orders, within a period of six weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the 1st respondent along with a copy of the application dated 27.12.2010 and a copy of this order.
6.This writ petition is disposed of with the above directions. No Costs.
