[Respondent] Petition filed under Section 439(b) of the Criminal Procedure Code, to modify the condition "the petitioner /accused should execute a bond for Rs.10,000/- with two sureties each like a sum of Rs.10,000/- with tax receipt and solvency certificate to the satisfaction of the learned Judicial Magistrate No.IV, Tiruppur", in the order passed in C.M.P.No.208 of 2017 dated 10.03.2017 by the learned Judicial Magistrate No.IV, Tiruppur.

O R D E R

By the impugned order dated 10.03.2017 in C.M.P.No.208 of 2017 in Crime No.672 of 2016, the learned Judicial Magistrate No.IV, Tiruppur, granted bail to the petitioner on certain conditions. One of the conditions is that the petitioner has to produce two sureties each for the like sum of Rs.10,000/- with tax receipt and solvency certificate. Now the present petition has been filed to issue a direction to modify the said condition. 2.Mr.C.Emalias, learned Additional Public Prosecutor, took notice for the respondent.

3.Heard both the sides.

4.Considering the facts and circumstances of the case, the condition imposed by the learned Judicial Magistrate No.IV, Tiruppur in the order dated 10.03.2017 in C.M.P.No.208 of 2017 in Crime No.672 of 2016, with regard to production of sureties, https://hcservices.ecourts.gov.in/hcservices/

is modified to the effect that the petitioner shall produce two sureties each for the like sum of Rs.10,000/- with tax receipt only. The condition with regard to production of solvency certificate while producing sureties, is deleted. Rest of the conditions imposed by the Judicial Magistrate No.IV, Tiruppur, shall remain unaltered.

5.This petition is ordered accordingly.
