Though private notice was served to the 2nd respondent and its name appear in the cause list, there is no representation on behalf of the 2nd respondent.

Heard the learned counsel for the petitioner.

Being satisfied with the reasons assigned in the affidavit filed along with the petition the delay of 915 days in filing the appeal is condoned.

It is made clear that petitioner is not entitled to claim interest for the delay period of 915 days on the enhanced award amount, in case of her success in the appeal.

Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order and list the same for admission.
