This petition has been filed seeking to set aside the returned docket order in Crl.MP.SR.No.6983 of 2025, dated 07.11.2025 passed by the Judicial Magistrate, Ambur and direct the Judicial Magistrate, Ambur to take on file and number the petition filed by the petitioner u/s.175(3) of BNSS . ORDER

This petition has been filed seeking to set aside the returned docket order in Crl.MP.SR.No.6983 of 2025, dated 07.11.2025 passed by the Judicial Magistrate, Ambur and direct the Judicial Magistrate, Ambur, to take the petition filed by the petitioner u/s.175(3) of BNSS on file and number the same. 2.The case of the petitioner is that he has filed a petition under Section 175(3) of BNSS against one Mrs.Rajathi and 3 others. The learned Magistrate had returned the petition on various dates with the following observations:

3.Seeking to set aside the last returned docket order dated 07.11.2025, the present Original Petition has been filed. 4.On perusal of the returns, it is seen that the learned Magistrate has returned the .petition on several occasions prior to 07.11.2025. On 04.11.2025, the learned Magistrate, holding that the transactions are illegal in nature, had rejected the petition and the petitioner had once again re-presented the same on 07.11.2025 and the learned Magistrate has returned the same. When the learned Magistrate had rejected the petition on 04.11.2025, as rightly pointed out by the learned Magistrate, only a revision would lie against the order dated 04.11.2025 and hence, the petitioner cannot once again re-present the same. 5.In view of the above, this Court is not inclined to entertain this petition and accordingly, this Criminal Original Petition stands dismissed. However, liberty is granted to the petitioner to file a revision against the order dated 04.11.2025.

6. Registry is directed to return the papers to the counsel for the petitioner.
