Mr.Stalin Abhumanyu, learned Additional Government Pleader accepts notice for R1 to R3 and is armed with instructions to enable final disposal of this Writ Petition, even at the stage of admission. No notice is thought necessary to private respondent, arrayed as R4, in light of order proposed to be passed now taking into account his interests as well.
2. The petitioner claims to be absolute owner of the property at Kupapalayam Village in S.No.528/1D and cultivating the same. He has made a request to the official respondents, i.e., Revenue Divisional Officer (North),/R1, Tahsildar/R2 and Village Administrative Officer/R3 on 04.07.2022 for levelling of the land.
3. Mr.Stalin would state that the acknowlegement placed for service of representation dated 04.07.2022 is only on R3, whereas the enquiry in regard to the petitioner's request has already been commenced by R1. The next date of enquiry is slated on 01.03.2024 and the matter is thus under process.
4. In such circumstances, the prayer for mandamus directing R1 to consider representation dated 13.02.2024 is really unnecessary except that a 2 / 4
time frame is being fixed for expeditious disposal of the matter. The allegation made as against the private respondent is that the matter is dragging at his instance.
5. Thus, in disposing the representation of the petitioner, which is already in process, R1 will hear R4 as well and complete the proceedings within a period of six (6) weeks from 01.03.2024, in accordance with law.
6. This Writ Petition is disposed as above. No costs. Connected Miscellaneous Petition is closed.
