Contempt Petition filed u/s.11 of the Contempt of Courts Act, 1971, praying to punish the respondents herein for their act of willful disobedience of the order passed by this Court in W.P.No.16672 of 2015 dated 29.07.2015. For Petitioner :

O R D E R

This contempt petition is filed to punish the respondents for willful disobedience of the order passed by this Court in W.P.No.16672 of 2015 dated 29.07.2015, in which, this Court ordered as follows: "10.3. It is made clear that if the petitioners joined the service after 01.10.1970 and even if they were promoted as Middle School 2/4

Headmasters, the petitioners are not entitled to seek the benefit of Selection Grade/Special Grade pay in the post of Middle School Headmasters, by counting the service rendered as Secondary Grade Teachers/Primary School Headmasters, from the date of their promotion as Middle School Headmasters.

11. The above said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order, in the light of the aforesaid directions. It is also made clear that if the petitioners joined service after 01.10.1970, they could not ask for Selection Grade/Special Grade in the post of Middle School Headmasters, by counting the service rendered as Secondary Grade Teachers/Primary School Headmasters."

2. Learned counsel appearing for the petitioners made a submission that the petitioners joined in service before 01.10.1970 and therefore, they are eligible for the benefits and their date of appointment is also extracted in the order passed by this Court.

3. Learned Special Government Pleader appearing for the respondents made a submission that the eligibility of the petitioners was verified with reference to their service records and accordingly, the authorities have passed an order in proceedings dated 24.11.2021. Based on the said order dated 24.11.2021, the amount due to the petitioners has also been settled. This being the factum, there is no further adjudication needs to be entertained in respect of the contempt petition.
