The written statement with counter claim is filed on the 92nd day after receiving the suit summon. The limitation prescribed under the statute is 30 plus 90 days i.e., in total 120 days. Since the written statement filed with condone delay application is well within the expiry period of 90 days, the delay of 62 days in filing the written statement with counter claim is condoned.

Taking note of the fact that the defendant carrying on business at Mumbai and the lack of connectivity due to pandemic, this application is allowed.
