O R D E R

The petitioner, who was arrested and remanded to judicial 1/4

custody on 22.01.2025 for the offences under Sections 8(C), 20(b)(ii)(B), 29(1) and 25 of Narcotic Drugs and Psychotropic Substances Act, 1985, in Crime No.28 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused was in possession of 1.300 kgs of ganja and 160 Nos of Tydol tablets. Hence the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in custody from 22.01.2025 and he is ready to abide by any stringent conditions that may be imposed by this Court. Therefore, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that there are totally eight accused in this case and the petitioner herein is ranked as A1. He further submitted that the petitioner along with other accused was in possession of 1.300 kgs of ganja and 160 Nos. of Tydol tablets and the petitioner is having 31 previous cases 2/4

and he is a history sheeter in H.S.No.2 of 2018. Hence, he opposed for grant of bail to the petitioner.

5.Heard the learned Counsel for the Petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

6. Taking into consideration the above facts and circumstances of the case and the submissions made by either side of the parties and the previous cases against the petitioner, this Court is of the opinion that the petitioner has not satisfied the twin conditions required under Section 37 of NDPS Act. Therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 14.02.2025 drl 3/4
