This application has been filed to grant leave of this Court to institute the suit as against the defendants who are having office outside the jurisdiction of this Court at Mumbai.

2. The plaintiff is a financial institution. They claim to have lent money to the defendants and they claim that the defendants are defaulters under a loan contract as amended from time to time. According to them, the defendants owe them a sum of Rs.45,95,71,918/-. The contracts were entered into only at Chennai where the plaintiff is having its registered office. Money was also lent from Chennai and part payments was also received from the defendants only to the Bank Account at Chennai. All the contracts also specify that the Court at Chennai has got jurisdiction to decide any dispute arising out of the contract.

3. Since major part of cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant Leave to Sue as prayed for in ABDUL QUDDHOSE,J.

A.No.903 of 2024 dpq in this application. Accordingly this application is allowed as prayed for.

4. Registry is directed to number the suit, if it is otherwise in order.

5. The learned counsel for the plaintiff is permitted to serve notice in advance to the respondents/defendants about the proposed suit and intimate them that in all probability the suit will be listed for hearing on 19.02.2024. The learned counsel for the plaintiff is also permitted to serve notice through all modes of service including e-mail.
