ORDER
The learned counsel for the respondent has brought to the notice of this Court to a letter dated 06.06.2012 addressed to Mrs.Suganthi, the petitioner herein stating that the nominee under the Policy No.753639861 is her mother-in-law Mrs.K.Jayalakshmi.
2.It is also brought to the notice of this Court, a receipt issued by K.Jayalakshmi, the mother-in-law of the petitioner who is the nominee under the policy that she has received a sum of Rs.2,33,674/- towards policy amount which includes the interest paid upto date of payment. Since the payment has already been made to the mother-in-law of the petitioner who is the nominee under the policy, nothing survives for adjudication in this writ petition.
3.Recording the submissions made by the learned counsel for the respondent which is supported by documentary evidence referred to supra, the writ petition is dismissed as infructuous. No costs.
4.It is made clear that the order passed in this writ petition will not preclude the petitioner from in any way claiming her share from and out of the money which K.Jayalakshmi as nominee has received as the maturity value under the policy held with the first respondent by her deceased son.
