Respondents PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, seeking a direction to the III Assistant City Civil Court, Chennai to dispose the O.S.No.3505 of 2016 on the file of the III Assistant City Civil Court, Chennai within a time frame. For Petitioner : Mr.S.Kasirajan

ORDER

This Civil Revision Petition has been filed seeking a direction to the III Assistant City Civil Court, Chennai, to dispose O.S.NO.3505 of 2016 within the time limit fixed by this Court.

2. The petitioner is the plaintiff and respondents are the defendants in O.S.No.3505 of 2016. The petitioner filed the suit for declaration to declare the sale deeds and release deed as null and void, for partition to divide the suit property into six shares and to allot 1/6th share to the petitioner, to direct the first respondent to deposit the rent collection of Rs.75,000/-, for permanent injunction and other consequential reliefs. In the said suit, the respondents 1 to 3 and 12 filed written statement in the month of August 2016. Tenth respondent filed written statement on 15.11.2016. Even after filing the written statement, the learned Judge has not framed issues in the said suit and has not taken up the suit for trial. Due to pendency of the suit, the petitioner is facing mental agony at the hands of the respondents every day. In the circumstance, the petitioner has come out with the present civil revision petition for early disposal of O.S.No.3505 of 2016.

3. Heard the learned counsel appearing for the petitioner.

4. Having regard to the submissions made by the learned counsel for the petitioner, considering the limited prayer sought for in the civil revision petition, without expressing any opinion with

regard to the merits of the matter, I direct the III Assistant City Civil Court, Chennai, to dispose O.S.No.3505 of 2016 on merits and in accordance with law, as expeditiously as possible, in any event, not later than six months from the date of receipt of a copy of this order.

5. The Civil Revision Petition is disposed of with the above direction. No costs.
