[Judgment of the Court was delivered by R.SUBRAMANIAN,J.] Challenge in this Writ Appeal is to the order of the learned single Judge dated 05.09.2002 made in W.P.No.10360 of 1995, in and by which the Writ Petition filed by the appellant challenging the land acquisition proceedings was dismissed by the learned single Judge.
2. The only point that was raised was that the Section 6 declaration have been made after the statutory period from the date of Section 4(1) Notification. The learned single Judge, on facts, found that Section 6 declaration has been made within the statutory period from the date of Section 4(1) Notification. Apart from that, we are also informed by the learned Government Advocate that the Writ Appeal in W.A.No.3738 of 2002 which arose out of the same acquisition proceedings has been dismissed by the Division Bench on 13.12.2002.
3. In view of the same, we do not see any reason to interfere with the order of the learned single Judge. Accordingly, the Writ Appeal fails and the same is dismissed. However, there will be no order as to costs. Consequently, the connected miscellaenous petition is also dismissed. Sd/- Assistant Registrar(CS VIII) //True Copy// Sub Assistant Registrar To
