Respondent PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, directing the Principal District and Sessions Judge at Kallakurihi to dispose the petition in Criminal Miscellaneous Petition in Crl.M.P.No.142 of 2024 pending on the file of the Principal District and Sessions Judge at Kallakurichi.

O R D E R

This Criminal Original Petition has been filed seeking a direction to the Principal District and Sessions Judge, Kallakurichi, to dispose the Crl. M.P.No.142 of 2024 within the stipulated time.

2. The petitioner is an accused in C.C.No.31 of 2024 on the file of the Judicial Magistrate, Tirukkoyilur. The petitioner raised grounds and filed a petition for transfer the entire trial from the file of the Judicial Magistrate, Tirukkoyilur, to any other Judicial Magistrate Court within the District, before the Principal District and Sessions Judge, Kallakurichi in Crl.M.P.No.142 of 2024 and it is pending.

3. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that in C.C.No.31 of 2024, the prosecution has already examined all the witnesses, and the trial is now posted for the evidence of the Investigating Officer. At this stage, the petition for transfer of the trial cannot be considered.

4. In view of the above, the Principal District and Sessions Judge, Kallakurichi is directed to dispose the Crl.M.P.No.142 of 2024 within a period of four weeks from the date of receipt of a copy of this order, in the light of the present status of C.C.No.31 of 2024 on the file of the Judicial Magistrate, Tirukkoilyur.

5. With the above direction, this Criminal Original Petition stands
