PRAYER: This criminal miscellaneous petition has been filed under Section 528 of BNSS, to relax the condition that the petitioner shall report before the respondent police every day at 10.30 a.m., until further orders imposed by this Court in Crl.O.P.No.799 of 2025 dated 20.01.2025. ORDER

This petition has been filed to relax the condition that the petitioner shall report before the respondent police every day at 10.30 a.m., until further orders imposed by this Court in Crl.O.P.No.799 of 2025 dated 20.01.2025.

2. The learned Government Advocate (Crl.Side) for the respondent police would submit that the petitioner committed the offences under Sections 8(c), 20(b)(ii)(c), 25 & 29(1) of the Narcotic Drugs Psychotropic Substances Act, 1985, in Crime No.804 of 2024; that the petitioner has not been complying with the condition imposed by this Court; and that he had complied only for six days, i.e., from 02.02.2025 to 07.02.2025.

3. At this juncture, the learned counsel for the petitioner would submit that the petitioner met with an accident; that his right leg was broken; that he took treatment and hence, he could not comply with the conditions imposed by this Court in Crl.O.P.No.799 of 2025 dated 20.01.2025.

4. Heard both sides.

5. Since the petitioner has not complied with the conditions, this Court is not inclined to entertain this petition. However, since the petitioner met with an accident, giving liberty to the petitioner to file a modification petition, this criminal miscellaneous petition is dismissed. 19.02.2025 dk Page No.3 of 4
