Criminal Original Petition filed under Section 528 of BNSS, 2023, seeking to direct the respondents, particularly the second respondent-police, to register a First Information Report, investigate the matter and file a final report in view of the order passed in Crl.M.P.No.10053 of 2021, on the file of the learned Judicial Magistrate V, Coimbatore, so as to secure the ends of justice and prevent miscarriage of law.

ORDER

This criminal original petition has been filed seeking to direct the 1st respondent-police (however, wrongly mentioned as the 2nd respondent in the prayer portion in the petition), to register an FIR, conduct investigation and file a final report, in view of the order dated 03.08.2021 passed by the learned Judicial Magistrate V, Coimbatore, in Crl.M.P.No.10053 of 2021.

2. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the 1st respondent, on instructions, submitted that pursuant to the order dated 03.08.2021 passed by the learned Judicial Magistrate V, Coimbatore, in Crl.M.P.No.10053 of 2021, directing the 1st respondent police to conduct enquiry on the petitioner's complaint and register an FIR and proceed in accordance with law, if any cognizable offence is made out, the 1st respondent-police have conducted investigation/ enquiry on the petitioner's complaint and subsequently, registered an FIR in 2/4

Crime No.108 of 2026 for the offences under Sections 420, 406, 120B, 506(I) and 34 of IPC as against the respondents 2 to 5 herein, on 16.02.2026 ie., yesterday and that the investigation in this case is under progress and the 1st respondent-police will be able to complete the investigation and file a final report as expeditiously as possible.

3. Recording the above submission made by the learned Government Advocate (Criminal Side), this criminal original petition stands disposed of accordingly.
