In a proposed suit for recovery of a sum of Rs.5,56,56,993/- and a further sum of Rs.7,50,000/- from the defendants, the intending plaintiff seeks leave to sue the first respondent before this Court.

2. Learned senior counsel for the plaintiff submits that the entire cause of action arose in Chennai where the tender was floated and the time charter was executed. Since the first defendant resides outside Chennai, he submits that leave has been sought.

3. Upon examining the draft plaint and on considering the above submissions, it is evident that the cause of action has arisen within the jurisdiction of this Court. Therefore, A.No.1016 of 2023 is allowed by granting leave to the applicant to institute the suit against the first respondent before this Court. As a corollary, the Registry is directed to number the suit, if otherwise in order.
