PRAYER: Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to issue new ration card to the petitioner under the Essential Commodities Act, based on the application dated 15.06.2011 given by the petitioner to the second respondent, without any further delay.

Heard both sides. By consent, the writ petition is taken up for final disposal at the admission stage itself. 2.The petitioner is married and he has two children. He was issued with a ration card bearing no.06/G/0076715 for his family in the year 2004. The ration card is enclosed at page no.1 of the typed set of papers. As per the ration card, he resided at Door No.123, Pa Gopuram 1st Street, Thiruvannamalai - 606 601. The petitioner resides in rental house and he has shifted his residence and therefore, he applied for new ration card.

3.It is stated that the second respondent informed the petitioner to surrender the earlier ration card and apply for new ration card. Therefore, the petitioner surrendered his ration card on 15.06.2011 and applied for new ration card. Though he made an application on 15.06.2011 for new ration card, for the past four years, the same was not issued to the petitioner. He also made repeated representations and the last of the representation is dated 19.03.2015. The said letter dated 19.03.2015 was sent through registered post with acknowledgment due. It is now stated that, no reply is received from the respondents.

4.It is a different matter if the petitioner is using two ration cards. According to him, he surrendered the earlier ration and he wants a new one. In this regard, he made an application on 15.06.2011. Now, four years have lapsed. There is no reason for not issuing the ration card.

5.Therefore, the writ petition is disposed of with a direction to the respondents to issue ration card to the petitioner, based on his application dated 15.06.2011, within a period of four weeks from the date of receipt of a copy of this order.
