ORDER : The Court Made the following order :- Petitioners, who was arrested and remanded to judicial custody on 29.02.2020 for the offence punishable under Sections 8 (c), 20(b)(ii)(C)29(1) of the NDPS Act in Crime No.10 of 2020, seek bail.

2. Totally there are 3 accused in this case and the petitioner herein arrayed as A2. The case of the prosecution is that the petitioner was in possession of 8 kgs Ganja. It is further alleged that A1 and A3 were is possession of 10 kgs and 8 kgs of Ganja. Hence, a case has been registered against the petitioner.

3. The counsel for the petitioners submit that the petitioners have not committed any offence as alleged by the prosecution. Hence he prays for grant of bail to the petitioner. 4.The learned Additional Public Prosecutor submits that the petitioner along with other accused entered into a criminal conspiracy and divided the contra band into lesser quantity in order to escape from the hands of the respondent and the total quantity seized was 24 kgs which is more than the commercial quantity. Hence she vehemently opposed for grant of bail to the petitioners.

5. Considering the fact that the value of contraband is very high more than the commercial quantity, this Court is not inclined to grant bail to the petitioner.

Accordingly, this Criminal Original Petition is dismissed.
