O R D E R

The respondent passed an order in G.O.(Ms.)No.32 Home, Prohibition and Excise (VIII) Department, dated 20.11.2015 determining the amount of interest payable to the petitioner. The Government have also made it clear that necessary funds would be provided in the Revised Estimates/ https://hcservices.ecourts.gov.in/hcservices/ Final Modified Appropriation 2015-2016 to meet the

expenditure incurred by way of payment of interest to the petitioner.

2. This Court earlier, at the instance of the respondent permitted to adjust the amount payable to the petitioner against future excise liability. It is open to the respondent to adjust the amount now payable to the petitioner by way of such adjustment. Such adjustment should be completed on or before 31.03.2016, in view of the fact that the matter has been pending before this Court for a considerable time. In case, it is not possible to complete such adjustment on or before 31.03.2016, necessarily, the remaining amount should be paid by way of cheque to the petitioner, within a period of four weeks thereafter.
